4. SMS Messaging

Our platform sends SMS messages to leads who have initiated contact by submitting property inquiries through listing platforms such as Zillow, Realtor.com, and similar services. By submitting an inquiry, leads consent to receive follow-up communication regarding their property inquiry.

All SMS messages include opt-out instructions. Recipients may reply STOP at any time to immediately cease all messaging. We honor all opt-out requests promptly and maintain a suppression list to prevent future messages.

Message frequency varies based on lead engagement. Standard message and data rates may apply.

5. Data Sharing and Disclosure

We do not sell personal information to third parties. We may share information with:

Service Providers: Third-party services that help us operate our platform, including Twilio (SMS delivery), Stripe (payment processing), Supabase (data storage), and Anthropic (AI services).
Our Clients: Lead information and conversation data are shared with the real estate agent or business that the lead contacted.
Legal Requirements: When required by law, subpoena, or legal process.

6. Data Security

Client account data is retained for the duration of the subscription. Lead data is retained according to client preferences and applicable law. 1. Agreement to Terms

By accessing or using the NetSkill Leads platform and services ("Services") operated by NetSkill Ventures LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use our Services.

2. Description of Services

NetSkill Leads provides AI-powered lead response and appointment scheduling services for real estate agents and other businesses. Our platform automatically sends SMS messages to leads on behalf of our clients, facilitates AI-powered conversations, and schedules appointments through calendar integrations.

3. Account Registration

To use our Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Services to send unsolicited marketing messages or spam.
Send messages to individuals who have not initiated contact through a property inquiry or similar opt-in mechanism.
Violate the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any other applicable telecommunications or marketing laws.
Upload or transmit false, misleading, or deceptive content.
Attempt to gain unauthorized access to our systems or other users' accounts.
Use the Services in any way that could damage, disable, or impair our infrastructure.

5. SMS Messaging Compliance

You are responsible for ensuring that all leads contacted through our platform have provided appropriate consent to receive messages. You acknowledge that messages may only be sent to individuals who have initiated contact through property inquiry forms or similar mechanisms. You must honor all opt-out requests immediately.

6. Pricing and Payment

Our Services are offered on a subscription basis with pricing as described on our website or as agreed upon during onboarding. A one-time activation fee may apply. Subscriptions renew automatically each month unless cancelled. Payments are processed through Stripe. You are responsible for providing accurate and current billing information.

7. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Activation fees are non-refundable. Monthly subscription fees are non-refundable for partial months. We reserve the right to suspend or terminate accounts that violate these Terms.

8. Intellectual Property

All content, features, and functionality of the NetSkill Leads platform are owned by NetSkill Ventures LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the fullest extent permitted by law, NetSkill Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use our Services.

Our total liability for any claim arising from these Terms or our Services shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless NetSkill Ventures LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any applicable law.

11. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, error-free, or that any specific results will be achieved through use of our platform.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through our platform or via email. Your continued use of our Services after changes take effect constitutes acceptance of the updated Terms.
